MAARIMAIA is a brand/trading name of MAIA TRADING (hereinafter referred to as “MAARIMAIA”), a company incorporated in Malaysia. Our company registration number is 002520223-V.
The terms, conditions and notices (hereinafter known as “Terms of Services”) stated on this page and other related documents apply on any product and/or services (collectively known as “Services”) listed and/or rendered to you while accessing and using our website www.maarimaia.com (hereinafter referred to as the “Site”).
By using the Services, you are agreeing to all the terms and conditions related to the usage and access of the Site, as may be updated by MAARIMAIA from time to time, with or without notice. You should understand that by ordering any of our products, or partaking in any promotions, or using the Site for any purpose, you are bound by these Terms of Services. Please check this page regularly to note any changes which may have been made to the Terms of Services.
Use and access to this Site is allowed on a temporary basis, subjected to MAARIMAIA’s discretion and decision. MAARIMAIA reserves the right to withdraw and/or amend any information regarding the use of Services without notice. Including the access to some parts and/or the entire Site. This also extends to MAARIMAIA’s online and offline partnerships and collaborations with external suppliers and partners. MAARIMAIA is also not liable if, in any event, the Site is unavailable at any time, or for any period.
“Terms of Services” may be used interchangeably with “Terms and Conditions” and “T&C” in the site.
To use some of the services or features made available to you on this Site you will need to register. When you register you are required to provide information about yourself that is true, accurate, current, and complete in all respects. Should any of your registration information change, please rectify your user details on your user account page or notify us immediately at the following e-mail address email@example.com
MAARIMAIA reserves the right to close accounts if any user is seen to be using proxy Internet Protocol addresses in order to attempt to hide the use of multiple accounts or which disrupts any of our services in any way.
If you use multiple logins for the purpose of disrupting the community you may have action taken against all of your accounts.
3.ELIGIBILITY TO PURCHASE
In order to make purchases on the Site you will be required to provide your personal details. In particular, you must provide your real name, phone number, e-mail address and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the Billing information provided.
The Site is available only to individuals and others who meet the MAARIMAIA’s terms of eligibility, who have been issued a valid credit/debit card/bank account by a bank acceptable to MAARIMAIA, whose applications are acceptable to MAARIMAIA and who have authorized MAARIMAIA to process a charge or charges on their credit/debit card/online banking account in the amount of the total purchase price for the merchandise which they purchase.
To use MAARIMAIA’s Services, you must be at least 18 years of age, possessing a valid Credit or Debit card issued by a bank acceptable to us at the point of purchase. If you are under 18 years old, you may use MAARIMAIA’s Services only with the involvement and permission of your parent or guardian.
By using MAARIMAIA’s Services and confirming a purchase, you have authorised MAARIMAIA to process a charge or charges on your Credit or Debit or bank account in the amount of the total purchase price for the product(s) purchased.
Products purchased by the buyer are for personal or gift use and should not be re-sold, used for commercial purposes or any other commercial benefit. In addition, MAARIMAIA reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address. By making an offer to purchase merchandise you expressly authorize us to perform credit checks and where MAARIMAIA feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your credit/debit card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorization and to authorize individual purchase transactions.
Furthermore, you agree that we may use Personal Information provided by you in order to conduct appropriate anti fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.
You must not misuse this Site. You shall and will not commit or encourage a criminal offence, transmit or distribute a virus, spyware and/or malware including but not limited to Trojan horse, worm, logic bomb, or post any other material on the Site, or its related social media and/or communication platforms, which is malicious, technologically harmful, in breach of confidence, or in any way offensive or obscene; hack into any aspect of the Service and/or Site; corrupt data; cause annoyance to other users; infringe upon the rights of any other person’s proprietary rights; send any unsolicited advertising or promotional material; or attempt to affect the performance or functionality of any computer facilities of, or accessed throughout this Site. Breaching this provision would constitute a criminal offence. MAARIMAIA will report any of such breach to the relevant law enforcement authorities and appropriate legal action will be undertaken.
MAARIMAIA will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, malware, spyware or any other technologically harmful material that may infect your technological device(s) used to access the Site and/or Linked Sites, computer equipment, computer programs, data, or other proprietary material due to your use of the Site and/or Linked Sites, or to your downloading of any material posted on Site and/or Linked Sites.
Your use of the Site and its contents grants no rights to you in relation to any copyright, designs, trademarks and all other intellectual property and material rights relating to the Content (as described in the Content section below), including MAARIMAIA Software and all HTML and other code contained in this Site. All such Content including third party trademarks, designs, and related intellectual property rights mentioned or displayed on this Site are protected by national intellectual property and other laws and international treaty provisions. You are permitted to use the Content only as expressly authorized by MAARIMAIA and/or its third party licensors. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format whether digital or physical, any of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.
Any reproduction or redistribution of the above listed Content is prohibited and may result in civil and criminal penalties. Without limiting the foregoing, copying and use of the above listed materials to any other server, location or support for publication, reproduction or distribution is expressly prohibited. However, you are permitted to make one copy for the purposes of viewing Content for your own personal use.
MAARIMAIA and Maarimaia.com are trade marks in the process of registration and belonging to MAARIMAIA. No licence or consent is granted to you to use these marks in any way, and you agree not to use these marks or any marks which are colourably similar without the written permission of MAARIMAIA.
These Terms of Services shall apply at all times, to all orders and contracts made or to be made, when you use MAARIMAIA’s Services for the sale and supply of products. In any event when you use the Site, including but not limited to, submitting a purchase order to us, giving any delivery instruction, or accepting delivery of the order, this shall constitute your unqualified acceptance of these Terms of Services. These Terms of Services shall prevail over any separate terms put forward by you. Any conditions that you submit, propose, initiate or stipulate in whatever form and at whatever time, whether in writing, by email, or verbally, are expressly waived and excluded. No other terms shall be binding unless agreed in writing, authorised and signed by MAARIMAIA.
In addition to the Intellectual property rights mentioned above, “Content” is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this Site. MAARIMAIA tries to ensure that the information on this site is accurate and complete. MAARIMAIA does not promise that MAARIMAIA’s Content is accurate or error-free. MAARIMAIA does not promise that the functional aspects of the Site or MAARIMAIA’s Content will be error free or that this Site, MAARIMAIA Content or the server that makes it available are free of viruses or other harmful components. We always recommend that all users of the Internet ensure they have up to date virus checking software installed.
By posting you agree to be solely responsible for the content of all information you contribute. You also grant to MAARIMAIA a right to use any content you provide for its own purposes including republication in any form or media. Comments may be moderated and may take up to 72 hrs to be displayed but MAARIMAIA does not commit to checking all content and will not be liable for third party posts.
MAARIMAIA reserves the right at its sole discretion not to publish or to remove any comment including those that it believes may be unlawful, defamatory, racist or libelous, incite hatred or violence, detrimental to people, institutions, religions or to people’s privacy, which may cause harm to minors, is detrimental to the trade marks, patents and copyrighted content, contains personal data, improperly uses the medium for promoting and advertising businesses. This site is available to the public, information you consider confidential should not be posted to this site.
8.LIMIT ON LIABILITY
The information displayed on this Site is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law, MAARIMAIA and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Sites and/or the Linked Sites and any content posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise.
We are also not responsible for failure to meet any of our obligations under this Terms of Services where such failure is due to events beyond our reasonable control. Such events include, but not limited to strikes, lock-outs or other industrial action; civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; impossibility of the use of public or private telecommunications networks; the acts, decrees, legislation, regulations or restrictions of any government, shipping, postal or other relevant transport strike, failure or accidents. In the circumstance that any of the events last for more than one week, either you or we may terminate the Contract forthwith by written notice and without any liability other than a refund of a product already paid for by you and not delivered. The refund will be made fully via MAARIMAIA’s Store Credit. If we are prevented from fully meeting our obligations due to any of these events, we have the sole discretion which Contracts we will perform and to what extent. We also reserve the full right on the solution adopted in meeting our obligations under the Contract despite such events.
These Terms of Services shall not exclude or limit MAARIMAIA’s liability for death or personal injury arising from its negligence, fraudulent misrepresentation, and misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.
You agree to indemnify, defend and hold harmless MAARIMAIA, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use this Website or your breach of the Terms of Service.
MAARIMAIA shall have the right in its absolute discretion at any time and without notice to amend or remove the Services and/or any page of this Website.
11.LINKS TO THE SITE
You may link to MAARIMAIA’s Site, provided you do so in a way that is fair and legal and does not damage or take advantage of our reputation. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any site that is not owned by you.
This Site must not be framed on any other site, nor may you create a link to any part of this Site other than the home page. We reserve the right to withdraw linking permission without notice.
If any part of these Terms of Services are determined by any court of competent jurisdiction or competent authority to be invalid, unenforceable or unlawful, the enforceability of any other part of these Terms will not be affected; all remaining terms, conditions and provisions will continue to remain valid, effective and enforceable to the fullest extent permitted by law. So far as possible, the invalid term can be severed to render the remaining part valid and enforceable. You agree that the term shall be rectified therefore, and interpreted in a way closest to the original meaning of the term permitted by law.
Failure or delay by MAARIMAIA in exercising any rights or remedies stated in this Terms of Services during the term of agreement does not constitute a waiver of such rights or remedies, or affect any other subsequent event or impair any rights or remedies in respect of it. It does not relieve you from compliance with such obligations. A waiver by us, if any, of any default, does not represent or determine a waiver of any subsequent default.
No waivers of any these Terms shall be effective unless expressly stated to be a waiver, communicated to you in writing and authorised by a management representative.

15.GOVERNING LAW & JURISDICTION
These terms and conditions are to be construed in accordance with the laws of Malaysia and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Malaysian courts.
These Terms of Services shall not be deemed as to create a partnership, agency, contract or a relationship of employer and employee between MAARIMAIA and you.
17.Rights To Vary Terms
MAARIMAIA retain the absolute right and discretion to amend, remove or vary the Terms of Services, any page of this Site or any Services provided at any time, without prior notice. Amendments to these Terms of Services will be posted on Site. However, use of the Site, including but not limiting to browsing of products and make a purchase, will be deemed to constitute acceptance of the current Terms of Services. The responsibility to review the latest Terms of Services is to be undertaken by you each time a new Order is made. Your continued use of the Site indicates your assent to the Terms of Services as posted.
18.TERMS OF SALE
By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Delivery time listed on the site is an estimate. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please see our DELIVERY RATES notice for further information.
a) YOUR ORDER
All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers. MAARIMAIA offers products for sale that are in stock and available for dispatch from our distribution center.
Occasionally however, we may be waiting for shipments from our suppliers. Consequently you may from time to time be given the possibility of making an Advance Payment for certain PRE-ORDER/ BACKORDER items in which case you are able to make an Pre-order/Backorder advanced purchase. This will ensure that you receive this item in priority once stock has been delivered to MAARIMAIA. MAARIMAIA will only take pre-orders/backorders for stock that has been scheduled for delivery .Your rights regarding Pre-order/Backorders are the same as those for any other purchase at MAARIMAIA. Alternatively, you may simply choose to register your email address for notification of arrival of the selected merchandise not held in stock. Items received into stock may be pre-allocated to satisfy Pre-orders and customers making Advance Payments will receive items in priority to customers on the Waiting List or customers ordering through the Site for immediate delivery.
Please be aware that we may be unable to deliver selected Pre-ordered/backordered merchandise due to production problems or quality check issues identified when we receive an order into stock. In these circumstances we will notify you by email and refund the Advance Payment to your customer account as STORE CREDIT within thirty days of being advised that merchandise has become unavailable.
Please be aware that on occasion certain products that are in particularly high demand will sell out during this period. MAARIMAIA will store a record of your transactions for a minimum of one year.
b) ACCEPTANCE OF YOUR ORDER
Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it and are processing your order. Acceptance of your order and completion of the contract between you and MAARIMAIA will be completed when we email you to confirm the goods have been dispatched. The sale contract is therefore concluded in Malaysia and the language of the contract is English. Neither our third party payment processor nor our nominated courier has the authority to accept an order on behalf of MAARIMAIA.
We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the Terms of Service.
We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
Whilst every effort is made to make sure details on our website are accurate, we may from time to time discover an error in the pricing of products. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. We shall be under no obligation to accept or fulfill an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted or is in transit. If you order a product that is priced incorrectly for any reason, we will email you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If you have already paid for the goods, we shall refund the full amount in Store Credit as soon as we are able. In the event that products are recalled in transit, we will process your Store Credit refund once the products have been returned to us.
The Site may also contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fulfill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.
You shall bear all delivery costs where applicable; such additional charges are clearly displayed where applicable and included in the ‘Grand Total’.
c) PRICING POLICY
Prices shown on the site are in MYR(Malaysian Ringgit) and USD (US Dollars).
All orders will be processed in Malaysian currency, Ringgit (MYR) . You may view the product price on the product page and process your orders in USD, but will be directed to the PAYPAL page at checkout for USD processing . The exchange rate will be pegged to the current prevailing exchange rate set by the Malaysian banking and financial institutions and will be determined by MAARIMAIA.
Product prices are set at the beginning of each season using existing currency exchange rates. These prices are subject to change if the applicable currency exchange rate changes before your order is accepted or the items are subject to markdowns at any time during the selling period.
MAARIMAIA ships on a DDU (Delivery Duty Unpaid) basis, as such, product prices displayed are exclusive of all taxes and duties. As the recipient, you are liable for all import duties, customs and local sales taxes levied by the country you are shipping to. Payment of these is necessary to release your order from customs on arrival.
Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfill the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.
Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.
e) DISCOUNT CODES
There are two ways of receiving a discount code:
- We may send one to you via email for reasons such as, without limitation, your birthday, or your MAARIMAIA anniversary.
- From time to time, we may offer discount codes on the Site that you can apply at checkout in order to receive a specific discount from us.
Only one discount code can be used against an order at any one time. A discount code can’t be applied to an order after that order has been placed. Discount codes are non-transferable and there is no cash alternative.
If the discount code has expired, you won’t be able use it.
We’re afraid we can’t accept any responsibility once we have given you a discount code and we are not obliged to provide you with a replacement if it gets lost and/or gets used by someone else as this will result in the discount code being cancelled.
If a discount code is offered on the Site and can’t run properly because of fraud, tampering, technical errors or anything else that is beyond our control which affects the running, administration, security or fairness of the discount code, we reserve the right to cancel, modify or suspend the discount code.
Discount codes are non-transferable and cannot be exchanged for cash. If you receive a discount code, it can only be used by you on your own MAARIMAIA account for the purpose for which it was issued. You must keep it confidential and only use it for making your own orders on MAARIMAIA. Don’t pass your code directly on to others or make it available to others (for example, posting it on social media or on a forum). If we believe that at the point of purchase or retrospectively you are abusing the use of discount codes in any way (for example, selling them to others), we reserve the right to cancel your discount code or suspend/close your MAARIMAIA account without letting you know beforehand.
We reserve the right to amend these terms and conditions at any time.
f) INSURANCE AND DELIVERY
You will own the goods on and from the later of the point in time when: (a) we receive payment in full, or (b) we deliver the goods to you.
MAARIMAIA insures each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by MAARIMAIA, and transfer of responsibility in the same way.
The goods are your responsibility from the time we deliver them to the address you gave us. Please note that we aim to dispatch all orders within 3 working days , and may take longer during sale periods. Delivery times appearing on the Site are estimates and are to be used as a guide only and commence from the date of dispatch. In any event, we will deliver the goods to you within 30 days of the day on which we accept your order.
MAARIMAIA is not responsible for any delays caused by destination customs clearance processes. If delivery is delayed by any event outside of our control, we will contact you as soon as possible to let you know and we will take steps to minimize the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to cancel your order and we will give you a refund for any goods you have paid for but not received.
19)EXCHANGE AND RETURNS
a) RETURNING YOUR PURCHASE
Making a return for a store credit refund, or exchange is easy. You must request a Returns Merchandise Authorization (RMA) number online and send your item(s) back to us within the stipulated time frame of 7 days from receipt of order and in the stipulated conditions in our EXCHANGE AND RETURNS policy. A ONE TIME EXCHANGE/RETURN IS PERMITTED PER ORDER. All exchanges/returns MUST be delivered using a registered delivery service with TRACKING CODE.
Items should be returned unused and with all garment tags still attached. Returns that are damaged or soiled will not be accepted and will be sent back to the customer and/or a refund refused. All items returned should have a Return Merchandise Authorization (RMA) number to allow easy identification and prompt processing. Unidentified returns will be returned to the sender.

Currently we only allow exchanges for local PENINSULAR MALAYSIA residents only. Please note you can only exchange items once per order for the same product in a different size , based on stock availability. If you wish to exchange your item for an alternative product, please return it for a store credit and purchase the new item separately. All other returns from East Malaysia (Sabah & Sarawak) and international orders will be treated as a return for STORE CREDIT.
In the event we are unable to provide a suitable replacement we will make a refund to you via store credit and notify you via email. Kindly allow us up to 7 working days to process your return/ exchange.
For local Peninsular orders, shipping costs on the replacement item is complimentary. For all other orders, your returns will be processed as a return for STORE CREDIT. See costs for EXCHANGE AND RETURNS.
c) RETURN FOR STORE CREDIT
Returns are open to both local and international customers. All delivery and customs charges as well as original shipping costs will not be refunded. For RETURNS that are successfully received & processed, the returns will be made via STORE CREDIT within 5 working days. The value of the shop credit will be the paid price of return item(s), in Malaysian currency(MYR) and credited into your MAARIMAIA customer account directly. Store credit for international returns are pegged to prevailing exchange rates stated by Malaysian banking and financial institutions. The store credit can be used to make any purchase on our site within 3 months from the date of refund. Unused credit will eventually be voided upon expiry. Remaining store credit after a purchase will remain in your customer account, until the 3 months expiry. Shop credit is STRICTLY NOT exchangeable for cash. See our EXCHANGE AND RETURNS POLICY, RATES AND TIMELINE here.

d) FAULTY GOODS
We deem a product faulty based on the following
- Manufacturing fault
- Product delivered is completely different from what is featured online in terms of style, size, and/or colour.
Please note: Slight colour variance between the physical piece and what is featured on our website may be due to your computer/tablet/phone settings of saturation and brightness. Kindly allow a 20% variance . Handwoven fabrics may vary in colour, print, and texture, which are signatures of the human hand and may vary by piece. Items with delicate fabric may shrink,fade or transfer colour without proper wash and care. In these cases above, it will not constitute as a fault.
All defect cases will be handled on a case by case basis. We reserve the right to determine if a product is faulty or not as evidenced.
As soon as you discover a fault, please email us immediately at firstname.lastname@example.org with:
- The order number
- The faulty item’s name and SKU code: looks something like MM16-001BLK
- Attached clear photos of the fault from a few angles with description of the fault.
Once return is processed, please return the faulty item to us as a return following the usual returns procedure. Once we have received the item, we will issue a refund in the form of Store Credit .We will also reimburse your cost of shipping the faulty item back to us in the form of store credit and your next shipment delivery cost will be on us! Please INCLUDE YOUR SHIPPING INVOICE/RECEIPT with your parcel/ email it to us for us to reimburse your shipping cost.
Please note, customs duties/taxes will not be refundable.

e) SALE ITEMS
Sale items purchased during our sale clearance or items purchased with promotional codes cannot be returned or exchanged.
f) BOUNCED DELIVERY
Customers will be contacted via email should we receive any bounced parcels bearing their name.Cost for re-delivery will be borne by the customer. MAARIMAIA will bear the cost of re-delivery if it is deemed as an error on our part. Details regarding the re-delivery will be provided in the email sent to the customer.
MAARIMAIA reserves the right to deny any request to combine the bounced back parcels with any new orders.
Any unclaimed bounced back parcels after 30 days grace period will be forfeited.
g) REPEATED RETURNS
We allow one exchange/return per order. We offer a flexible returns policy to make your online shopping experience even easier.
